Complaint of the Viktor Gyokerres dismissal clause, made by lawyer who could have an impact on Arsenal and Man UTD
A lawyer said that Viktor Gyokertes may have to pay a huge fine if he refuses to play for sport as a “ termination clause ”.
Gyokerres was the center of the largest summer transfer saga, with a move to Arsenal which now seems inevitable after weeks of negotiations.
The Swedish scored 97 goals in 102 games in the previous two seasons, making him one of the most requested attackers in Europe, Man Utd also trying an agreement for the attacker.
Although Arsenal accepted fixed costs of 55 million pounds Sterling last week, discussions on additional modules block an agreement.

He wrote: “So let’s talk about the law: what Gyokerres did, missing work for five consecutive days without justification is just a reason for dismissal.
“Football players are not only workers; these are club assets: they have a liberation clause that allows clubs to sell them.”

With the gyoker liberation clause set at 100 million euros (85 million pounds sterling), a termination clause would technically mean that the Swedish owes this amount to his employer.
However, the good news for Gyokerres is that if activated, a termination clause must be proportional to the employee’s salary.
Article 25 of the Act on the Sports Sports Contract stipulates: “If the amount is manifestly excessive, it can be reduced.
Guerreiro added: “Now there is no doubt that these clauses are excessive: if Gyoker wins two million per year, he should work 50 years just to pay the clause. It is the servitude, not freedom of work. And fortunately, the servitude was abolished a long time ago.”

Although this may seem an extreme scenario, this would not be the only recent case of this.
Francisco Conceição had to give up six million euros, corresponding to 20% of its transfer fees in order to facilitate a permanent decision to Juventus.
